The Goa Real Estate Regulatory Authority (RERA) has instructed Aansav Realty and Infrastructure Pvt Ltd, a developer based in Margao, to execute a sale deed and transfer possession of a 137sqm flat located in its Aansav Verde project at Varca to Sonia Singh Bhardwaj, a buyer from Gurugram, within a period of 60 days.
The RERA determined that the developer had unlawfully cancelled her allotment and failed to deliver the apartment more than seven years beyond the agreed deadline. Vincent D’Silva, a member of RERA, mandated the developer to pay a penalty of Rs 10 lakh under the RERA Act for breaching its regulations, along with Rs 5 lakh in costs to the complainant, both of which are to be paid within two months. Should the developer fail to comply, further legal action will be pursued.
Additionally, RERA instructed the woman to settle any outstanding dues to facilitate the completion of the flat handover. Bhardwaj had booked a 137sqm flat on the first floor of Block P in Aansav Verde for a total amount of Rs 53 lakh in 2015.
The developer was required to deliver possession by July 2018, which was three years after the initial payment, in accordance with Supreme Court rulings. However, the completion certificate was only obtained on November 21, 2025, and the occupancy certificate on December 4, 2025.
The authority concluded that the developer’s cancellation of the allotment letter in March 2023 was unlawful and unfounded, as WhatsApp communications between the developer’s sales manager and the complainant’s husband, as recent as February 2025, confirmed an outstanding balance of merely Rs 8.9 lakh. The developer contended that the woman was an investor rather than a legitimate homeowner, a claim that was dismissed by RERA.
