HRERA Dues Recovery Begins Against Haryana Developers

The Gurugram district administration has initiated recovery proceedings against more than 10 real estate developers for failing to pay nearly ₹296 crore in penalties imposed by the Haryana Real Estate Regulatory Authority (HRERA). The move marks one of the strongest enforcement actions taken to ensure compliance with regulatory orders and provide relief to affected homebuyers.

According to officials, the penalties relate to around 380 cases where developers failed to hand over possession of residential units within the timelines promised to buyers. Individual penalties range from ₹25 lakh to ₹2 crore, reflecting the extent of delays and non-compliance across multiple projects.

Despite receiving repeated notices from HRERA directing them to clear the outstanding amounts, the developers failed to comply. As a result, the authority declared them defaulters and requested the district administration to recover the dues under applicable legal provisions.

The recovery process will begin with the issuance of formal notices to the defaulting developers. If the outstanding penalties remain unpaid within the stipulated period, the administration will proceed with the attachment of movable and immovable properties owned by the developers. These assets may subsequently be auctioned to recover the pending amount.

Officials stated that each case will be examined individually before enforcement measures are taken. Revenue authorities have been instructed to verify ownership records, assess outstanding liabilities, and identify assets that can be attached. The recovery process will be carried out through the district’s revenue machinery at the tehsil level, following established legal procedures.

The action follows a review meeting chaired by the Gurugram Deputy Commissioner, during which the revenue department was directed to prepare developer-wise records of pending dues and expedite recovery proceedings. The administration said the objective is to strengthen enforcement of HRERA orders and improve accountability among developers who fail to comply with statutory obligations.

The enforcement action is expected to provide some relief to hundreds of homebuyers who have been waiting for possession of their homes for several years. Buyers from residential projects located in Sectors 109, 65, 63A, 68, 95, 103 and 104 have repeatedly raised complaints over construction delays despite making substantial payments. Many had approached HRERA seeking compensation, timely project completion and possession of their flats.
