TG RERA penalises DLF Gayatri Developers, others over non-compliance

The Telangana Real Estate Regulatory Authority (TG RERA) has imposed a penalty of 2.5 lakh on DLF Gayatri Developers, a joint venture between Gurgaon-based DLF India Limited and Hyderabad-based Gayatri Infra Private Limited (GIPL), and three other real estate entities for marketing and selling plots without registering their project under TG RERA.

A complaint was filed by eight individuals, who alleged that the developers marketed plots under the ‘DLF Garden City’ project in Nandigama village in Kothur mandal of Rangareddy district without obtaining the required TG RERA registration. The project, which spans 108 acres, was presented to buyers as a high-end residential layout.According to the complainants, the project received a draft layout approval from the Hyderabad Metropolitan Development Authority (HMDA) in 2012, subject to specific conditions, including the completion of development works and the release of mortgaged land.

However, the developers allegedly failed to disclose these restrictions adequately to buyers.

Following the enactment of the RERA Act in 2016 and the Telangana RERA Rules in 2017, all ongoing projects without a completion or an occupancy certificate were required to register with TG RERA. The complainants argued that the developers, aware of this requirement, did not register the project, claiming an exemption as the project was initiated before the rules came into effect. However, no completion or occupancy certificate was obtained before Jan 1, 2017, disqualifying the project from such exemptions under the law.

The developers contended that the project approvals predated the RERA Rules and that it was fully completed, with applications for completion certificates submitted to HMDA.

After reviewing the submissions, TG RERA, on Jan 21, ruled that the project qualified as an ongoing project under the Act, as no completion or occupancy certificate was issued.

The authority imposed the penalty under section 59 of the Act, emphasising that it was a deterrent against similar violations and not a measure to regularise breach.
