Jharkhand Plans 10% Surcharge on Urban Property Transfers

The Jharkhand government has proposed a 10% surcharge on property transactions within urban local bodies and industrial township areas as part of its efforts to strengthen the financial position of municipal authorities. The proposal has been outlined in the draft Jharkhand Municipal Land/Building Transfer Surcharge Rules, 2026, which has been released for public consultation.

Under the proposed rules, the surcharge will be levied on the total amount of stamp duty and registration fees paid during the transfer of land and buildings located within municipal limits. The additional revenue generated through the surcharge will be transferred directly to the respective urban local bodies and utilized for both revenue and capital expenditure, supporting infrastructure development and civic services.

According to the Urban Development and Housing Department, the initiative is aimed at improving the financial sustainability of municipalities across the state. Officials stated that many civic bodies face revenue constraints, making it challenging to fund essential public services and development projects. The proposed surcharge is expected to create an additional source of income for these local authorities.

The draft rules are currently open for public feedback until July 24, 2026, after which the government will review suggestions before finalizing the regulations.

The surcharge collection process will be integrated into the existing online property registration system. The Department of Revenue, Registration and Land Reforms, which already collects stamp duty and registration charges, will also collect the additional surcharge. The amount will then be transferred directly to dedicated bank accounts of the respective municipal bodies through an integrated payment gateway, ensuring transparency and efficient fund transfer.

The draft also provides for refunds in cases where a property transfer is not completed. In such instances, the surcharge will be refunded in accordance with the existing procedures applicable to stamp duty and registration fee refunds.

Once implemented, the regulations will apply to all areas governed under the Jharkhand Municipal Act, 2011, including municipal corporations, municipalities, municipal councils, and notified industrial townships. The proposal reflects the state’s continued efforts to enhance local government finances while creating a dedicated funding mechanism for urban development and civic infrastructure.
