DTCP Upholds Oberoi Realty’s Gurugram Project Licence

The Haryana Department of Town and Country Planning (DTCP) has rejected a representation filed by Advance India Projects Limited (AIPL) seeking cancellation of the licence and change of developer approval granted in favour of Oberoi Realty for a residential project in Gurugram.

In an order dated August 13, 2026, the DTCP held that Licence No. 69 of 2025, issued on May 12, 2025, and the June 17, 2025 approval permitting the change of developer in favour of Oberoi Realty remain legally valid.

Dispute Over Three Sixty North Project

The matter concerns Three Sixty North, Oberoi Realty’s residential project on Golf Course Extension Road in Sector 58, Gurugram. The project involves a 14.8-acre land parcel that was previously covered by licences issued between 2009 and 2012 and was initially marketed as the Grand Hyatt Residences project.

AIPL had challenged the validity of Licence No. 69 of 2025 and the subsequent approval allowing Oberoi Realty to become the developer. The company had sought cancellation of the licence, parent licences and the change of developer approval.

The DTCP rejected the representation, stating that it was without merit and that no action was required under the Haryana Development and Regulation of Urban Areas Act, 1975.

High Court Restriction

The dispute had earlier reached the Punjab & Haryana High Court. In its July 7, 2026 order, the court had restricted IREO Group entities and Oberoi Realty from making fresh allotments or creating third-party rights in the project until the DTCP decided AIPL’s complaint.

The High Court had directed DTCP to examine the complaint under Section 8 of the Haryana Development and Regulation of Urban Areas Act.

Following the DTCP decision, Oberoi Realty stated in a regulatory filing that the restriction imposed by the High Court on further allotments and creation of third-party rights had ceased to be operative.

Developer Change and Land Transaction

According to earlier court submissions, entities associated with the IREO Group entered into an agreement for sale with Oberoi Realty in November 2023. A sale deed was subsequently executed in May 2024, following which DTCP approved the transfer of licences and change of developer.

The respondents, including the IREO entities and Oberoi Realty, had opposed AIPL’s request for interim relief. They argued, among other points, that the petitioner lacked the necessary locus standi.

Oberoi Realty had earlier stated that the High Court proceedings did not affect existing sales and that construction activity was not stayed.

With DTCP now rejecting AIPL’s representation, the department has upheld the validity of the developer change and Licence No. 69 of 2025. The decision allows the project to proceed subject to applicable approvals and ongoing legal requirements.
