Mahavir Developers booked for noise pollution norms breach

Pandey warned developers that failure to follow the rules could attract Indian Penal Code (IPC) sections.

Mahavir Developers from Chembur have been booked under Section 115 of the Bombay Police Act for breaching noise pollution norms by carrying out construction work after 10pm, among other violations like dumping debris in the area, said city police commissioner Sanjay Pandey during his weekly live-streaming on Sunday.

Pandey warned developers that failure to follow the rules could attract Indian Penal Code (IPC) sections. “Last week, we had a meeting with CREDAI-MCHI—an apex body comprising members from the real estate Industry in Mumbai Metropolitan Region—but the developers had taken my instructions lightly. Now, they will understand that violating rules will attract stern action. In the Chembur builder case, they continued laying slabs and creating noise pollution after 10pm,” Pandey said, during his third live Facebook streaming.

Reiterating his advice to bikers and motorists not to break traffic rules, the police chief said that as such violations now attract an FIR, it could hamper their chances of getting or renewing their passport. As many as 1,215 motorists have been booked for rash and dangerous driving under the IPC and Motor Vehicle Act since March 16.

An average 81 traffic violation cases, including wrong-side driving, are registered daily across the 93 city police stations. “I request parents…to guide their children not to violate traffic rules… they will be in trouble as they will not get a passport or renew it. It also will create a problem for their future job prospects when their character and background checks are done by companies,” Pandey said.

He added that he has taken note of other issues that Mumbaikars are facing, such as harassment by elected bodies of cooperative societies, noise pollution from construction sites, and use of loudspeakers for local sporting events. “I have been receiving complaints from building residents that the secretary and chairman are disconnecting their power and water supply at the behest of builder…I have instructed officials from local police stations to take note of the complaints…Action will be taken under IPC against them,” he said.

Pointing out that using loudspeakers for commentary of local sporting events, especially on grounds in Malad and Goregaon, is a nuisance for residents, he warned of action under the Bombay Police Act. A week after he instructed all personnel to be polite to citizens who visit police stations, Pandey said he is awaiting feedback from Mumbaikars.

The city top cop said dedicated bicycle lanes will be demarcated on Sundays and the police band will play music for Mumbaikars at key locations, including Girgaum Chowpatty. He added that they will place a plaque describing the bravery of ASI Tukaram Omble in English and Marathi so that tourists know how the Ashoka Chakra recepient was killed by Pakistani gunmen during the 2008 terror attacks.
