Life certificate not needed to execute deed if POA given

TNRERA said the three have executed power of attorney in 2012. Noting that these power of attorneys have not been revoked, the order said notices served by the counsel show that they are alive.

In an order relating to a housing project, where three original owners of a joint venture were refusing to issue life certificates, Tamil Nadu Real Estate Regulatory Authority (TNRERA) directed a sub-registrar office to execute the undivided share (UDS) based on the power of attorney (POA) issued to the developer without insisting on life certificate.

The housing project is being developed by Green Choice Constructions Pvt. Ltd in KK Nagar. A complaint was filed by 11 land owners with TNRERA seeking the authority to direct the sub-registrar office of Virgambakkam to register the sale deed and UDS in the favour of the land owners without insisting on life certificate. But the promoter stated that three land owners are refusing to give life certificates.

TNRERA said the three have executed power of attorney in 2012. Noting that these power of attorneys have not been revoked, the order said notices served by the counsel show that they are alive. Citing an order of the Madras high court, the authority directed that having executed the agreements and power of attorney in favour of the promoter, the sub-registrar shall accept the execution of UDS without insisting on life certificates.
