The Odisha Real Estate Regulatory Authority (ORERA) has passed orders penalizing two separate real estate developers Rs 20 lakh each for violations of different sections of the Odisha Real Estate Regulation and Development Rules 2017.
In one order, the ORERA fined a developer Rs 20 lakh for violating Section 3 of the Act that states promoters cannot book, offer to book, sell or advertise their properties without getting the said projects registered with ORERA. Any violations in this regard would attract a penalty of up to 10 per cent of the project cost, the act says.
ORERA booked the case suo motu and stated in its recent order that the developer applied for online registration in December 2019 for the project at Rudrapur village in Bhubaneswar, but without getting the approval of registration. It started putting up hoardings in the city as well as other parts of the state and advertise the property through online mode in January 2020.
In its order, the ORERA stated that the violator should pay the penalty of Rs 20 lakh within two months of the order, failing which action as per law will be taken against the defaulter.
In another order, the ORERA fined a real estate firm Rs 20 lakh for not executing a sale agreement with a homebuyer even after taking a booking amount of Rs 11 lakh for a property near Fire Station Square, Bhubaneswar. The ORERA issued the order acting on the complaint of the buyer himself.
Sources said in December 2017, the buyer booked the property and paid the booking amount of Rs 11 lakh and obtained the allotment letter. The buyer then asked for the sale agreement, following which the developer sent the document in email, which was not in proper format. When the buyer protested, the developer refused to listen, following which the complaint was filed.
