The chairman of the Andhra Pradesh Real Estate Regulatory Authority (APRERA), S. Suresh Kumar, has issued a warning to the public regarding the purchase of flats in apartments or plots in layouts that are not registered with AP RERA.
He emphasized that such transactions could lead to significant issues for potential buyers. “We have received reports indicating that certain developers, promoters, and builders are soliciting advance payments from buyers under the pretense of ‘pre-launch’ activities for proposed real estate projects before securing registration with APRERA.
Additionally, it has been noted that some real estate agents are participating in the marketing of these pre-launch projects. According to Section 3 of the Real Estate (Regulation and Development) Act, 2016, no promoter is permitted to advertise, market, book, sell, offer for sale, or invite individuals to purchase any plot, apartment, or building in any real estate project without first registering the project with APRERA.
Moreover, Section 10 of the Act stipulates that no real estate agent may facilitate the sale or purchase of any plot, apartment, or building in a project that lacks registration with APRERA,” stated Suresh Kumar.
He urged all developers, promoters, builders, and real estate agents to abstain from conducting any financial transactions or promotional activities with buyers under the guise of ‘pre-launch’ for unregistered real estate projects. He warned that any infringement would result in stringent legal repercussions from APRERA in accordance with the provisions of the Act. “Buyers are encouraged to reach out to the APRERA helpdesk for information regarding specific projects or to seek resolution for issues such as delays in possession, substandard construction quality, or other complaints,” Suresh Kumar added.
