Registrars, sub-registrars have no authority to issue NOC for redevelopment

Maharashtra Cooperation Commissioner Deepak Taware has issued an order clarifying that registrars and sub-registrars lack the authority to provide a ‘no objection certificate’ (NOC) to housing societies for the redevelopment of their properties.

The commissioner emphasized that the general body of the relevant cooperative housing society serves as the highest decision-making authority in the redevelopment process. Referring to a writ petition submitted to the Bombay High Court, Taware pointed out that according to a government resolution from 2019, the responsibilities and functions of registrars and cooperative societies are merely supervisory in nature.

There are no provisions within the Maharashtra Cooperative Societies Act of 1960 that grant the registrar the power to issue an NOC for the redevelopment of any cooperative housing society, the senior bureaucrat asserted.

The registrar does not possess the right to provide an NOC to cooperative societies for redevelopment, and the general body of the respective cooperative society is the ultimate authority in the redevelopment process, the order specified. Additionally, the order instructed registrars and sub-registrars to refrain from soliciting applications from cooperative societies for NOCs and to avoid issuing any such certificates.
