NMMC urges residents of buildings without OCs to apply

In a notable disclosure, 2,111 structures within the jurisdiction of the Navi Mumbai Municipal Corporation (NMMC) are found to be lacking the required occupancy certificates. In response to the directives issued by the Bombay High Court regarding a Public Interest Litigation and a subsequent Writ Petition, NMMC compiled a comprehensive list of non-compliant buildings following an extensive survey.

This information can be accessed at www.nmmc.gov.in and at all eight ward offices, detailing buildings that possess construction commencement certificates but do not have occupancy certificates. NMMC has urged occupants to obtain their occupancy certificates promptly to avoid enforcement actions. Following the high court’s directive dated October 25, 2024, authorities carried out thorough surveys to identify buildings operating without occupancy certificates, despite having received construction commencement approvals.

The NMMC has now made public the details of properties in their records that are functioning without the necessary occupancy certificates, even though they have construction commencement authorizations. The civic body emphasized that these buildings and societies are operating in contravention of established regulations.

This announcement serves as an important notice to the residents and owners of the 2,111 identified properties. It underscores the necessity of obtaining an occupancy certificate for all buildings within the NMMC jurisdiction prior to occupation. “The relevant parties are advised to promptly submit their applications for occupancy certificates to the Town Planning Department.

The civic administration hereby informs that non-compliance will lead to enforcement actions under the Maharashtra Regional Planning and Town Planning Act, 1966, as enforced by the designated officer,” stated NMMC Commissioner and Administrator Kailas Shinde. The municipal authority strongly encourages all parties involved to meet this regulatory requirement to ensure compliance with building safety and occupancy standards.

This initiative aims to maintain proper records and compliance with building regulations within the municipal limits. “This is a sheer lapse on the part of the civic administration and the civic body has to fix the responsibility on the ward officers of respective wards for dereliction of duties,” said an alert resident, Sameer Tupe.
