The Cuddalore district consumer disputes redressal commission has ordered four real estate promoters to pay Rs 1 lakh for failing to provide civic, religious, spiritual and other amenities as promised by them while promoting a project and for involving in unfair trade practices.
Commission president D Gopinath and members T Kalaiyarasi and V N Parthiban directed the developer to pay Rs 50,000 as compensation for causing mental agony, pain and suffering to the complainant and Rs 5,000 as litigation cost. They said the complainant is entitled to recover Rs 1.55 lakh with 9% interest from the promoters from the date of the order till the date of realization.
In his complaint, T Ramkumaran of Mantharakuppam stated that he bought two plots for Rs 1.2 lakh each on April 15 in 2013 in Chepaukkam village promoted in the name of Sri Narayanapuram extension by Sri Narayananpuram Foundation founder N Sivarajan of Neyveli, M Manimaran of Valaiyamadevi village, Chidambaram, S Balamurugan and M Vijaya of Chepaukkam village.
He said the promoters had promised to extend civic amenities like water and electricity, construct a commercial complex and develop a bio park besides promising to consecrate a Vinayagar temple and perform spiritual and religious ceremonies before 2016.
Ramkumaran said the promoters had failed to provide all civic amenities, construct a commercial complex and develop a bio park and consecrate a temple as promised by them in the advertisements to promote the layout.
The promoters in their petition claimed that they cannot lay roads, extend water and electricity connections as the amenities can be extended only by the state. They cannot be blamed as providing the basic amenities are the functions of the government. They can only provide the approval for layouts with the demarcation of roads and house sites. They said the temple would be constructed after the government accords approval.
