The Telangana Real Estate Development Authority (TGRERA) has imposed penalties on a builder and a real estate developer for infractions in distinct cases. In the initial case, TGRERA levied a fine of 7.6 lakh on Haris Pranava Builders located in Madhapur, following a complaint lodged by the Pranava Elite Association in Miyapur.
The complainant, a registered mutually aided cooperative society established by individual flat owners of the Pranava Elite Residential Building, claimed that the builder breached several conditions of the approved plan and failed to deliver essential amenities. The project, which was constructed under a building permit granted in 2019, was sanctioned for one stilt and five upper floors.
The society, in its complaint, outlined various construction deviations and a lack of promised facilities. These deficiencies included the absence of separate transformers and generators for each block, non-adherence to block-wise common amenities, the use of substandard construction materials resulting in wall cracks, defective wooden doors, water leakage, and pest infiltration.
TGRERA instructed the builder to address the water leakage issues within 30 days, to build toilets on the stilt floor in accordance with the approved plan, and to halt any promotion of the project under names other than the one registered with the Authority. The penalty is to be settled within 30 days to the TGRERA Fund. No rectification costs will be imposed on the allottees.
In a seperate case, TGRERA imposed a fine of 21 lakh on Kapstone Properties India Pvt Ltd, located in Nizampet, due to alleged infractions concerning a plotted development initiative at Kamsampalle village, within the Farooqnagar mandal of Rangareddy district.
Complainants Sunchu Santhosh Babu from North Lallaguda and Sunkara Kiran Kumar from Manikonda had entered into a memorandum of understanding with the builder for the acquisition of residential plots in a project promoted as ‘Little Woods’. However, despite receiving payments of 10 lakh and 12.8 lakh respectively, the builder did not fulfill the registration process.
The Authority observed that although the project was advertised as ‘Little Woods’, it was registered with Telangana RERA under the name ‘Whistling Meadows’. The builder, along with other related respondents, was deemed jointly and severally responsible for refunding the amounts received, in addition to 11% interest calculated from the payment dates until the refund date.
The refunds are required to be processed within 30 days. Furthermore, the Authority instructed the Telangana RERA secretary to officially designate Kakarla Srinivas as a defaulter. His photograph, along with the names of associated entities — Kapestone Infra, Jayathri Realties India Pvt Ltd, and Jaya Group — will be published on the RERA website under the ‘Defaulters’ List’. A comprehensive investigation into other potential regulatory breaches by the individual and related firms has also been mandated.
