The Real Estate Regulatory Authority (RERA) at Jaipur has seized several flats of a city-based builder to auction them to compensate buyers who did not receive possession of a flat even after paying the full amount.
The complaint in this matter was filed in RERA in May 2022, with the complainants stating that they had purchased a flat near D-Mart in Jagatpura in 2014 and the builders—Vishal Sharma and Naveen Hiramandani—had promised to complete the project and give possession of the flat by April 2018.The complainants stated that they had still not received the possession, nor had the promoters paid any compensation.
“Following the case, the RERA court initially directed the builders to return the amount paid by the buyers along with an interest 9.4% per annum till date by December 31, 2022. But the promoters violated that order. The court has now ordered to seal all the unsold flats of the developers and to recover the amount to be paid as compensation to the buyers,” said an official.
Advocate Rishi Maheshwari filed the case on behalf of the petitioners. RERA has issued an order to the Jaipur district collector to issue recovery certificate under Section 40(1) and directed to attach all the unsold properties of the developers. The unsold flats would be sold in auction to recover the amount paid by the buyer along with the additional interest.
RERA officials stated that in an earlier case, the authority had issued an order against the same developer. In that case a buyer had lodged complaint stating that the buyer did give possession of the flat and when the developer issued a cheque to return the amount paid by the buyer, the cheque bounced.
