Ninex Developers booked for cheating buyers

Ninex Developers— and its directors have been booked for allegedly cheating homebuyers of several crores and selling their allotted flats to another private company, police said.

Complainant Rajendra Anand, a resident of Sector 43, has alleged that he booked a flat for over Rs 1 crore in 2016. The flat, along with 21 others, was later mortgaged to another private firm. When he tried registering a case against the builder in 2019, the latter promised a settlement.

The complainant alleged that the accused have still not honoured their settlement deed and that the cheques given to him and his wife were rejected by the bank.

“In 2016, we had given over Rs 1 crore to book a flat in Sector 76. We were told that the flat would be handed over to us by December 2017, but we never got that. We also came to know that the developer had mortgaged the property to another private firm, and the flats were later sold to someone else. In 2019, I filed a complaint against the developer, but no action was taken. A settlement deed was signed where we were promised Rs 3 crore, but we haven’t got any money as of now,” Anand alleged in his complaint.

Following this, Anand approached the Punjab and Haryana high court last year, seeking relief.

The court then ordered the police to lodge an FIR in the case. Based on the directions of the court and as per Section 156 (3) of the CrPc, a case has been registered against the developer in Sector 50 police station, and the directors of the firm have been booked under IPC sections 406 (criminal breach of trust), 420 (cheating and dishonesty), and 120 B (criminal conspiracy).

“The complainant has alleged that the accused developer has cheated many homebuyers of several crores. We are probing the matter to verify the charges,” said ASI Gajraj Singh.

Despite repeated attempts, the developer could not be contacted for comment on the matter.
