The department of town and country planning (DTCP) has issued a show cause notice to the developer of an affordable residential plotted colony in Farrukhnagar for selling off plot mortgaged to the bank.
The developer has been directed to file his reply within seven days and if he fails, action will be initiated against him as per the provisions of the Haryana Development and Regulation of Urban Areas Act 1975 and Rules 1976.
According to the department, Savyasachi Infrastructure was given licence on a 9-acre land in Sector 3 of Farukhnagar for developing plotted colony under Deen Dayal Jan Awas Yojna 2016.
As per the terms and the conditions of the licence, 15% saleable area in the layout plan is to be freezed due to mortgaged deed registered in the revenue record against bank guarantee. The area freezed shall be allowed to sell only after de-mortgage of land as shown in land schedule issued along with the licence.
But when DTP, on the orders of director DTCP KM Pandurang, got the site inspected, it was found that all the plots that were freezed as per the above terms and conditions of the licence have been sold in the form of agreements and receipt of payment.
The company’s sales executive informed the department that only one plot is available for resale in the said colony out of the mortgaged plots.
In the show cause notice, DTCP said that the developer has violated the terms and conditions of the licence and contravened the provisions of the Haryana Development and Regulation of Urban Areas Act 1975 & Rules 1976.
“You are directed to explain your situation within 7 working days and also directed to stop any further development works on the site and to explain as to why action should not be initiated against you,” reads the notice. District town planner (enforcement) RS Batth said, “We have written to the tehsildar, also an official will be sent to the tehsil office to ensure no sale deed of the plots under the project is registered.”
