Arrest warrant to Dreamz Infra MD for delay in delivery, refusing refund

A Bengaluru-based real estate company faced severe consequences for keeping home buyers in uncertainty by postponing the construction of a housing project for over a decade.

The company also disregarded the National Consumer Disputes Redressal Commission’s directive to refund the money, resulting in the commission issuing an arrest warrant. It instructed the city police commissioner to detain the managing director and present her before the commission.

Previously, the commission had issued a bailable warrant against Disha Choudhury, the managing director of Dreamz Infra India Ltd, for failing to comply with its order to appear. With no alternatives left, a bench comprising Justice Inderjit Singh and Sadhna Shanker ordered her arrest. This decision followed a plea from homebuyers, represented by advocate Chandrachur Bhattacharya, who sought the enforcement of the commission’s 2022 order to refund the money, a ruling that was also upheld by the Supreme Court.

In 2022, the commission mandated Dreamz Infra India Ltd to finalize construction and provide possession to the homebuyers, along with a delay interest of 9% per annum or to refund the money. Thousands of buyers who had purchased flats in Bengaluru’s housing projects in 2012 were deceived by the company, which had promised possession in 2014 but left them waiting for their flats even after 11 years past the deadline.

In April, the NCDRC issued bailable arrest warrants against Choudhary, stipulating her release on a personal bail bond of Rs 10 lakhs, accompanied by one surety of the same amount. However, the city police reported to the commission that they were unable to locate her to execute the warrants.
