Gujarat RERA Suspends Surat Housing Project Over Development Issues

The Gujarat Real Estate Regulatory Authority (GUJ RERA) has suspended the registration of a housing project in Surat and prohibited booking, selling, and marketing. The order, issued on February 21 by RERA Secretary AJ Desai, was directed to Bhuminbhai Rameshbhai Butani, a partner of Sahajanand Infrastructure Partnership Firm, and others involved in the Sahajanand Green City project in Kamrej, Surat.

The project, which includes residential and commercial units, was launched in 2015 and registered with RERA in 2018. According to RERA records, the project consists of 571 units in six towers, with 407 units still available for sale. The official completion date was September 30, 2023, but the project remains ongoing.

RERA’s action follows a January 18 letter from the Surat Urban Development Authority (SUDA) and an order recorded by RERA on February 20. Acting under Section 36 of the Real Estate (Regulation and Development) Act, 2016, the authority intervened due to issues with development permissions.

The order states that development permission granted for Block No. 166 of Moje Kamrej, Ta.- Kamrej, Surat has been suspended, halting any further construction at the site. This measure aims to protect prospective homebuyers and other stakeholders from potential risks.

With the project registration suspended, the developer is barred from marketing, booking, or selling units in Sahajanand Green City. The order also warns that any continued sales or marketing efforts will result in penal action under the RERA Act.

The suspension underscores GUJ RERA’s regulatory oversight in ensuring compliance and safeguarding homebuyers from delayed or uncertain projects. Authorities are increasingly monitoring projects to ensure developers adhere to legal requirements and commitments.

Homebuyers who have already invested in the project may now face uncertainty regarding possession and completion timelines. The RERA Act mandates that developers fulfill obligations, and any deviations can lead to legal consequences.

This action serves as a warning to other developers in Gujarat about the importance of adhering to approved permissions. It also highlights the need for homebuyers to verify project status on the RERA portal before making purchasing decisions.

The suspension of Sahajanand Green City reflects a broader effort by regulatory authorities to enforce compliance and prevent project delays. The case also emphasizes the role of legal oversight in maintaining transparency in real estate development. Developers must ensure all required approvals are secured to avoid legal action and protect the interests of homebuyers.
