Omaxe chairman & MD among nine booked for cheating

The complainant, Deepak Bhati, a resident of Sector Delta-1, claimed that he booked a shop in 2017 at the Omaxe Connaught Place Mall and the developer had assured him to hand over its possession in two years.

A case of cheating has been registered against nine persons, including the Omaxe Ltd chairman, managing director and four directors, on the orders of the district court after a buyer claimed he was yet to get possession of a shop at the Omaxe Connaught Place Mall in Sector Beta 2 for which he had paid over Rs 26 lakh to the developer six years ago.

The complainant, Deepak Bhati, a resident of Sector Delta-1, claimed that he booked a shop in 2017 at the Omaxe Connaught Place Mall and the developer had assured him to hand over its possession in two years. Six years on, when Bhati did not get possession of the shop, he filed a Right to Information query which revealed that of the proposed 1,000 shops in the mall’s original layout, the Greater Noida Authority had not approved nearly 170, including the one he had booked.

“I had booked a shop on the ground floor of the mall and paid a total of Rs 26.3 lakh. The builder gave me an offer letter too but kept delaying its possession,” Bhati said.

Bhati submitted a police complaint, but no action was taken. “Then, in March, I approached the district court which ordered that an FIR be against Omaxe Ltd chairman Rohtas Goyal, managing director Mohit Goyal, directors Jatin Goyal, Vineet Goyal, Gurnam Singh, Nishal Jain, business heads Sanjay Garg, Manish Garg and authorised agent Pradeep Tyagi,” he said.

When contacted, the mall management declined to comment on the issue.

The FIR has been registered under sections 420 (cheating), 406 (criminal breach of trust), 468 (whoever commits forgery, intending that the document or electronic record forged shall be used for cheating), and other relevant provisions of the Indian Penal Code (IPC) at Sector Beta-2 police station on April 1 following an order from the district court.

“We recorded the statement of the complainant on Wednesday. We will call the accused party for questioning in a day or two,” a police official said.
