Nitesh Estates refuses to follow K-RERA order, cheating case filed

Neeta Farzan Heerjee, a single lady, from Jamshedpur filed a complaint with the Halasuru police station on February 26. Neeta had purchased a flat in 2012 in Nitesh Columbus Square in Kattigenahalli on Bagalur Main Road.

A 58-year-old woman has filed a case against Nitesh Estates Ltd, one of the leading builders in the city, after they failed to return the amount which she had paid to purchase her dream home in Kattigenahalli, on Bagalur Main Road. She approached the police after the builders refused to pay Rs 91.72 lakh to her, which was awarded by the K-RERA judgement, that was in her favour.

Neeta Farzan Heerjee, a single lady, from Jamshedpur filed a complaint with the Halasuru police station on February 26. Neeta had purchased a flat in 2012 in Nitesh Columbus Square in Kattigenahalli on Bagalur Main Road.

The project was launched in 2010 and consists of six towers – A, B, C, D, E, F, of which D, E, F towers were completed and handed over for use, by 2016. The other three towers remained incomplete, and no money was not returned to the buyers.

Neeta had purchased apartment in tower A.

“I was promised that the flat would be handed over to me by August 2014, but they kept postponing the dates and giving me false hope. In 2015, I came to Bengaluru to follow up on my own and realized that the work was still incomplete.

Once again the Nitesh Estate staff convinced me that the work would be completed in six months, which further extended to two years. In 2018 November, I shifted to Bengaluru. Despite having paid 95 per cent of the amount, I was asked for extra money to complete the project, as they were short of funds.”

K-RERA judgement

“In January 2019, I approached K-RERA where the judgment was given in my favour and they agreed to pay me Rs 91.72 lakh in August 2019. They gave me a post-dated cheque on August 2 for December 1, which was dishonoured in January, as the account was blocked. I then filed a cheque bounce case against them,” added Neeta.

When Bangalore Mirror reached out to Nitesh Estates for comments on the case, they did not respond.
