Bangalore Development Authority (BDA) has been asked to register its Arkavathy Layout project immediately with Karnataka Real Estate Regulatory Authority (K-RERA).
The directive came in K-RERA’s interim order on November 3, while hearing a complaint filed by a site allottee seeking relief of interest on the delay period and direction to the promoter to complete the project.
A full K-RERA bench observed that BDA remained continuously absent during the proceedings held from September 1, 2022, to September 31, 2023. The BDA commissioner has been directed to register the project immediately under section 3 of Real Estate (Regulation and Development) Act, 2016 within two weeks from the date of receipt of the order.
BDA has also been asked to explain within three weeks as to why penalty proceedings under section 59(1) of the Act shouldn’t be initiated for violation of section 3. According to section 3, the developer should register the real estate project with RERA.
The complainant alleged that Arkavathy Layout project has faced multiple delays and is yet to be completed, and he hasn’t been given physical possession of the site and no amenities have been provided by BDA.
