Consumer court orders BDA to refund ₹8 lakh for delay in handing over flat

The IV Additional District Consumer Disputes Redressal Commission has mandated the Bangalore Development Authority (BDA) to reimburse Rs 8.03 lakh, along with an interest rate of 18%, to a resident of Marathahalli who has been waiting for nine years for the possession of a flat that BDA had assured would be delivered within a year.

On March 21, 2025, the Commission directed BDA to refund Rs 8.03 lakh, with an interest of 18% calculated from the date of the initial payment, in addition to Rs 1 lakh for service deficiencies, Rs 25,000 for mental distress, and another Rs 10,000 to cover litigation expenses.

The complainant, Suryaprakash H R, aged 70, had reserved a 1BHK flat in Gunjur village under the housing scheme designated for Economically Weaker Sections (EWS) on March 7, 2014, making an initial payment of Rs 1.12 lakh. According to Suryaprakash, BDA had allocated him a 1BHK flat in Gunjur through a lottery system, and on December 3, 2014, he was instructed to pay the remaining balance of Rs 7.87 lakh within six months.

To meet this requirement, Suryaprakash secured a housing loan of Rs 8 lakh, which was disbursed to BDA in four installments. However, following this, BDA failed to provide a definitive date for registration and did not respond to the complainant’s numerous inquiries. To make matters worse, the officials at the BDA office were unable to locate the file related to the allotment.
